And he's heading home to celebrate. (https://www.cnn.com/2021/06/30/us/bill-cosby-to-be-released/index.html)

The big thing I'm taking away from the news of his release is a severe loss of respect for Phylicia Rashad.

What? I thought you were talking about something important, like Alex Garcia, the mayor of Wasco California (https://www.latimes.com/california/story/2021-06-29/alex-garcia-wasco-pride-flag-central-valley) and his campaign to fly a rainbow flag over city hall.

I don't care enough to read why he was released, but assume the reason is bullshit. :dubious:

I respect that the law's protocols have to be followed properly.
I also recognize that nothing in this release says that the man is any less guilty. This release is an admission that protocol was violated, not that women weren't.
Rashad's comment of "My post was in no way intended to be insensitive to [survivors'] truth." is one of those bullshit non-apologies. Saying "It's okay that I hurt people because I didn't mean to!" is not an apology. An apology needs to recognize that hurt was caused, whether intentional or not, and sincerely express an intention to stop hurtful activity going forward.
I do miss pudding pops.

I don't care enough to read why he was released, but assume the reason is bullshit. :dubious:
Short version: In 2005 the Montgomery county DA promised (in a press release) not to prosecute Cosby for raping Costand. He made this promise because he didn't think he could get a conviction in a criminal suit, and instead tried to help the victim bring a civil suit instead.
Because of this promise, Crosby didn't (couldn't?) plead the 5th in the civil suit. You can't say "I'm not going to answer that because it could incriminate me in a criminal trial that the DA has promised won't happen."
Years later a new DA said that the prior DA's promise wasn't binding. Cosby's lawyers tried to argue that the old DA's promise should be upheld. The judge ruled that there was no signed agreement, only public statements made by the 2005 DA, so they went ahead with it.
The PA Supreme Court said that the 1st DA made an unconditional promise to not prosecute which resulted in Cosby giving up his constitutional right to plead the 5th in the civil trial, so going ahead with the criminal trial was a violation of his due process.
I don't think the reasoning is bullshit. It's a good example of why people involved in the law need to be super careful about following the rules/regulations - to keep guilty-ass people from walking free.

Solfy is right. DA fucked up. Phylicia Rashad is a cunt. The whole situation stinks, but at least the victims know that millions of people believe them.

Unfortunately, my takeaway is that this is example 40 billion of why women don't come forward about rape. What is the point? Reliving the assault for months (or years) for a vanishingly small chance of a conviction. Even if there is one, the sentence will be bullshit, with a side of "not wanting to ruin the man's life over one mistake." Then we get this. Why bother?
I'm expecting Weinstein to walk next.

Do they want a rash of extrajudicial punishments? Because that's how you get a rash of extrajudicial punishments.

I get it. Commit multiple crimes, cut some sweet ass deal to pay off one victim, and have no responsibility for the other crimes. That's efficiency!
The double jeopardy rule protects a person from being tried multiple times for the same offense. It should not apply to multiple offenses.

Statutes of Limitation is what got him off here. The double jeopardy rule is only for this one specific case. It sucks he's getting off so easily, I wish we had a system that encouraged woman to come forward in cases like this. But we still don't.

I heard part of an interesting radio show (https://www.wnycstudios.org/podcasts/takeaway/segments/what-bill-cosbys-release-means-survivors) this morning that was about how his release affects survivors of rape, especially women of color.

At least he won't be playing any more if his tricks. There isn't enough viagra in the world at this point.
Also, I don't think we're heaping enough hate on the dipshit DA who decided to rip up the Bill of Rights. That incompetent bastard is the only reason Cosby is out now.

Rashad's statement and defense of it is mind boggling. She not only made the statement but what she said, she said it the worst possible way.

I hate to say it, but I'm really not that surprised. If he were poor, would the outcome be the same? :violence:

While i think he is guilty as hell, the larger issue is the Constitutionality the right of against self incrimination.
Obviously guilty people getting off on "technicalities" makes me angry. But those "technicalities" are almost always constitutional based, although it may be foggy on first glance.
I, as an innocent person, don't want to get tricked into sending myself to jail by a shady DA.
Bill Cosby, a guilty person, getting out of jail, helps me.
