Militia movements and the actual law.
I've been reading up on Militia movements and the actual law. Hey, I minored in PoliSci in college. This stuff is catnip to me.
The Michigan Militia claims to be part of the 'Unorganized Militia' of the USA. Turns out that under US law, the 'unorganized militia' are subject to the command authority of their state government. Since they insist that their command authority is independent of the governor of their state, legally, they are an independent paramilitary organization, and have NO authority under the US, or the Michigan constitution. They are allowed to do it. Right up until they take arms and start shooting. Then they are 'fair game'. They become the type of organization that the state government is authorized to call out the 'unorganized militia' to suppress. They seem to have badly misread the actual law. Unfortunately, The Trumpkins seem to be that delusional. |
